When I arrived at his hotel room, I was already incapacitated and I couldn’t move my arms or my body. He raped me. And he choked me. And while he was choking me, I lost consciousness. And I thought I died.”
Swalwell’s attorney issued a statement vehemently denying all allegations. “Congressman Eric Swalwell categorically and unequivocally denies each and every allegation of sexual misconduct and assault that has been leveled against him. These accusations are false, fabricated and deeply offensive. A calculated and transparent political hit job designed to destroy the reputation of a man who has spent 20 years in public service.”
Friendship and Betrayal: Senator Gallego’s Regret
The accusations have particularly impacted those close to Swalwell, including Senator Ruben Gallego, who was a close friend and chaired Swalwell’s 2020 presidential campaign. Gallego expressed deep regret, stating, “Eric Swalwell lied to all of us. He lies the most powerful people in this country. And they trusted him. They trusted him with the most sensitive spots in our government, whether it was on Judiciary Committee, Intel Committee impeaching Donald Trump. And that clouded my judgment, my friendship with him, our families friendship together with him, clouded my judgment. And I was wrong. I deeply, deeply regret that. I also had no knowledge of predatory behavior, sexual assault or harassment.” Gallego admitted that Swalwell’s alleged actions could impact his own future political ambitions.
Legal Battles Loom: California and New York Investigations
In Los Angeles, where the latest accuser, Lana Drew, came forward, authorities are pursuing a criminal investigation. Drew claims she was drugged and choked by Swalwell during what she believed was a friendship. Her attorney emphasized that resignation from Congress is not accountability, and they seek justice through a criminal investigation. Drew stated she has evidence, including text messages and photos, and had informed others and sought therapy at the time. The LA County Sheriff’s Department has been approached to begin an investigation.
Legal analyst Misty Marris explained that the statute of limitations for forcible rape in California, which is the most serious potential charge, has not expired. For lesser sexual assault offenses, the statute of limitations is ten years, also still applicable. Corroborating evidence, such as Drew’s calendar entries and therapy notes, will be crucial for prosecutors to build a case beyond a reasonable doubt.
Furthermore, the Manhattan District Attorney’s office is also investigating an alleged assault by Swalwell involving another woman.
