Timothy Haifey, the former lead investigator for the House January 6 Committee, expressed strong criticism regarding recent actions by the Department of Justice (DOJ). He stated that the DOJ’s move to potentially wipe charges against some January 6 offenders is not about ending a two-tiered justice system, but rather creating one. Haifey argued that this approach unfairly benefits those who support the former president while targeting those who opposed him.

This move, according to Haifey, creates a situation where supporters of the president can avoid consequences for their actions, regardless of criminal conduct. He contrasted this with individuals who have shown courage in standing against the former president, suggesting they are unfairly targeted. Haifey believes this is the current reality of a two-tiered system, a stark departure from the findings of his committee and subsequent jury verdicts.

‘Tip of the Spear’ on January 6

Haifey described a group of individuals who were the “tip of the spear” on January 6th. He stated that these individuals intentionally and methodically planned to breach Capitol security.

Their goal was to enter the building and disrupt the joint session of Congress. The evidence gathered by the committee, he explained, was further supported by criminal prosecutors.

Two separate juries, one for the Proud Boys and one for the Oath Keepers, unanimously found these individuals guilty beyond a reasonable doubt. They were convicted of advocating the use of force to disrupt the lawful function of government. Haifey highlighted that this conviction was for seditious conspiracy, one of the most serious crimes in the federal criminal code, rarely used because it is rarely committed.

Questions About Presidential Pardons and DOJ Forethought

Haifey raised questions about why the former president did not fully pardon these individuals in the first place. He also questioned whether the DOJ should have anticipated this day, suggesting a lack of foresight. The former investigator admitted he cannot understand the motivations behind the former president’s decisions.

Haifey expressed confusion about the DOJ’s current stance. He reiterated his concern that the department appears to be going along with a plan that rewards the president’s supporters and punishes his opponents. He stated that the DOJ used to be guided by facts and the law, but this no longer seems to be the case.

DOJ Investigates Cassidy Hutchinson

The New York Times reported that the DOJ is also investigating Cassidy Hutchinson, a former White House aide. Haifey referred to her testimony where she recounted overhearing the president say, “I don’t even care that they have weapons.

Magnetometers, or “mags,” are used for security screening at the Capitol. The DOJ assigned its Civil Rights Division to the Hutchinson investigation. Haifey questioned why this investigation was happening and why it was assigned to the Civil Rights Division instead of the U.S. Attorney’s Office in Washington, which would be the usual path for such matters.

Pattern of Retribution, Not Civil Rights

Haifey suggested that the investigation into Hutchinson is part of a pattern. He believes it targets opponents of the former president, listing others like Letitia James, Jim Comey, and John Brennan.

These individuals, he noted, are targeted because they had the courage to stand up and tell the truth. The motive, he stated, is transparent: support the president and be forgiven, or oppose him and face consequences.

Regarding the involvement of the Civil Rights Division, Haifey found it unusual. He pointed out that investigations into contempt of Congress or lying to Congress typically go to the D.C. U.S. Attorney’s Office.

He mentioned that this office has recently had a poor record, with grand juries not indicting cases, which he finds historically unprecedented. Haifey suggested that leadership at the Justice Department might prefer to assign the case to the Civil Rights Division, led by a politically appointed individual he believes is willing to do the former president’s bidding. However, he sees this not as a civil rights issue, but as retribution.

Belief in the Rule of Law Remains

Despite his concerns about the DOJ’s actions and the perceived two-tiered system, Haifey expressed continued belief in the rule of law. He emphasized that any investigation must be supported by actual evidence of wrongdoing. Haifey stated he is unaware of any evidence that Cassidy Hutchinson intentionally lied to Congress.

He believes that even with flawed decision-making and a perceived two-tiered system, the rule of law and facts still matter. Haifey feels that Hutchinson, like others targeted, will benefit from these protections.
