Just one day before the California ruling, a jury in New Mexico found Meta in violation of state law. The company was found to have failed in safeguarding young users from child predators on its apps. The penalty in this case was substantially larger, with Meta ordered to pay $375 million in damages.

“The most important thing about these trials and about these verdicts is the information that the public is able to see that they just were not able to see before,” Franks stated. “The early rulings on these cases that let them go forward were unusual, and it meant that we got to ask questions, and we got to see the executives of these companies have to answer questions about what they knew and when they knew it and what they did about it.”
Tom Hartman, host of The Tom Hartman Program, drew parallels to the tobacco industry, suggesting that these verdicts could lead to significant changes. “Something will have to follow from this, whether it’s behavioral changes that are mandated by the government or legislation,” Hartman said. He used the analogy of a homeowner being responsible for illegal activities on their property, suggesting social media platforms are analogous to the “house” where harmful activities can occur.

“The focus is on saying, well, you can try to say that the content that you provide to people is not your fault, not your responsibility. But these cases are saying, well, what about the things that you yourselves as a company are offering?” Franks elaborated. She pointed to examples like beauty filters that contribute to body dysmorphia in young girls and design features intended to keep users hooked on harmful platforms.
A Shift Towards Greater Responsibility
The evidence presented in these trials suggests that companies may have been aware that their platform designs contributed to user harm. This counters the idea that negative effects are merely unintentional “bugs” and instead points to them being deliberate “features” designed to maximize engagement and profit. This perspective aligns with historical arguments made against industries that prioritized profit over public health.
Tom Hartman recalled his experience running online forums before Section 230 was enacted. He noted that moderators were paid to ensure a clean and orderly environment. “When Section 230 came, they just stopped paying us. And most of the moderation went away and most of the moderation went away and we got the modern internet,” Hartman observed. He suggested that a return to a model with greater moderation and accountability could lead to a safer online environment, even if it impacts company profits.
