Supreme Court Ruling Opens Door for Tariff Refund Lawsuits

In a significant legal development following the Supreme Court’s recent decision invalidating former President Donald Trump’s tariffs, a new push is underway to help individuals and small businesses reclaim billions of dollars in duties paid. The ruling, a 6-3 decision, declared the tariffs unconstitutional, leaving a clear path for those who were wrongly assessed these payments to seek redress.

The Legal Landscape After the Supreme Court Decision

The Supreme Court’s decision has created a “complete blank slate” for individuals and businesses that paid an estimated $150 billion in tariffs deemed illegal. Norm Eisen, co-founder of Democracy Defenders Action, highlighted the urgency and importance of this development in a recent interview. “In a better world, the administration would just say, ‘Sure, we’ll pay you back.’ They’re going to make people fight for them,” Eisen stated. Democracy Defenders Action, in collaboration with former New Jersey Attorney General Matt Platkin, is spearheading efforts to recover these funds, with a particular focus on small businesses.

Protecting Small Businesses: The Economic Stakes

Eisen emphasized the critical impact these tariffs had on small businesses, which often operate on thin profit margins. “These tens of thousands of dollars, in some cases hundreds of thousands of dollars that small businesses paid in tariffs are the difference between being profitable and declaring bankruptcy,” he explained. The legal strategy involves encouraging individual claims, which can then be centralized into a “mass action” to streamline litigation and increase the likelihood of recovery. This approach, Eisen noted, is often more efficient for business owners than a traditional class-action lawsuit.

“We’re going to fight for those small businesses… The Supreme Court has said very unequivocally, this was illegal by a 6-3 ruling. You had three liberals, three conservatives, different reasoning, same result, illegal tariffs. And there’s very strong case law that when an illegal tariff is assessed, you’re entitled to get your money back you were forced to pay under illegal circumstances.”

Broader Implications: Consumers and the Rule of Law

While the immediate focus is on businesses, the implications extend to consumers who bore the brunt of increased prices due to the tariffs. Eisen acknowledged that consumers also paid more for goods like electronics, clothing, and food. He urged consumers to engage in both the “court of law” and the “court of public opinion.” While businesses have direct legal standing to reclaim tariffs paid, consumers can support these efforts by speaking out and raising awareness. Eisen suggested that a successful recovery of these funds could potentially lead to positive impacts on affordability for all Americans.

Beyond financial recovery, the movement to reclaim these tariffs is framed as a defense of democratic principles and the rule of law. “Everybody who steps up to litigate this in the court of law or to speak out in the court of public opinion is also standing up for our rule of law for our democracy,” Eisen asserted. He pointed to the bipartisan nature of the opposition to these tariffs, noting that many conservatives have historically argued against such measures on free market principles.

How to Seek a Refund: Practical Steps

For small business owners impacted by the tariffs, a dedicated email address has been set up for inquiries: tariffrefunds@platkinlp.com. This initiative, spearheaded by former AG Matt Platkin and Democracy Defenders Action, aims to provide information and guidance on pursuing legal claims. Eisen encouraged those affected to reach out, stressing that while legal cases require individual assessment, collective action can amplify their impact.

“The first thing you need to do is to get information. Email Attorney General Platkin. He’s set up an email address. Tariff refunds. TARIFREFUNDS at Platkin LP LPLATKIN LP.com.”

Pushback and the Fight Against Authoritarianism

The former president reportedly reacted strongly to the Supreme Court’s decision, even imposing new tariffs in response. However, Eisen remains undeterred, drawing on extensive experience litigating against the Trump administration. He views these legal battles as crucial in pushing back against authoritarian tendencies and strengthening democratic institutions.

“History will look back for example at Minneapolis the way we talk about Birmingham or Selma as key inflection points in the civil rights movement. Um, we’ve we’ve seen a the real birth of a democracy movement that is stronger than Donald Trump’s authoritarianism,” Eisen stated, positioning the tariff case as another important declaration by the Supreme Court against such tendencies.

What’s Next?

The legal battles to recover the $150 billion in unconstitutional tariffs are just beginning. With the Supreme Court having unequivocally ruled against them, the focus now shifts to organizing claims, particularly for small businesses. The efforts led by Democracy Defenders Action and former AG Matt Platkin aim not only to secure financial redress but also to reinforce the principles of the rule of law and democratic accountability. Future actions may involve legislative responses from Congress or continued litigation, underscoring the ongoing struggle for economic justice and the preservation of democratic ideals.
