Judge Tosses Most of Blake Lively’s Claims Against Justin Baldoni

A federal judge in New York has significantly reduced the scope of Blake Lively’s sexual harassment lawsuit against her It Ends With Us co-star, Justin Baldoni. The ruling, made this week, dismisses 10 out of the 13 claims Lively had filed. This decision comes just one month before the case was scheduled to go to trial.
Key Claims Dismissed
Judge Lewis Lyman’s decision threw out Lively’s central claims of sexual harassment, defamation, and conspiracy. The judge also removed all individual defendants from the lawsuit, leaving only claims against corporate entities.
Entertainment attorney Trey Lavell explained the impact of the ruling, stating, “10 of the 13 causes of action have been kicked out. All of the sexual harassment claims have been kicked out. The defamation claims are out.” He added, “So it really leaves three remaining claims, two based on retaliation and one based on a breach of contract.”
Remaining Claims: Retaliation and Breach of Contract
Despite the dismissal of most claims, Lively is still allowed to pursue three specific allegations. These include:
- Breach of contract
- Retaliation
- Aiding and abetting retaliation
Lavell noted that these remaining claims, particularly those concerning retaliation, can still carry significant weight. “Although the majority of the claims have been kicked out, it still has some teeth because the retaliation claims can be very serious if there’s a finding of liability,” he said. “So, you know, we still have a case here.”
Understanding the Retaliation Claims
Lively’s legal team is arguing that Baldoni initiated a campaign of retaliation against her. This, they claim, was in response to her potential to bring forward allegations of harassment or discrimination on set. “She’s claiming, hey, you know, I was complaining about what was happening on set and Baldoni was worried that I was going to go to the press or was going to make claims and thus he wanted to have a retaliation campaign against me to diffuse any of that,” Lavell explained.
This type of claim focuses on conduct that occurred after filming, particularly actions taken in the public sphere or through public relations efforts that allegedly harmed Lively’s reputation. “So, it’s really based on on conduct that occurred after the filming, but in the press,” Lavell added.
Settlement Prospects Increase
The judge’s ruling has increased the likelihood of a settlement between the two parties. Both Lively and Baldoni’s teams have been engaged in settlement negotiations. Lavell believes this is a strategic move spurred by the reduced number of claims.
“One of the things that this motion for summary judgment does by kicking out the majority claims is it does encourage settlement,” Lavell stated. “I still think the chances of this case going to verdict are slim. I do think it’s going to settle. If it doesn’t settle before the trial starts, I wouldn’t be surprised if it settles during the trial, but I just don’t see the parties allowing this to go to verdict.”
Lively’s Legal Team Vows to Continue
Despite the setbacks, Lively’s legal team remains determined. A statement from a member of Lively’s legal team indicated their resolve: “The actor looks forward to testifying at a trial and continuing to shine a light on this vicious form of online retaliation so that it becomes easier to detect and fight.”
Should the case proceed to trial, Lively would have the opportunity to present her account directly. “She’s going to get up and she’s going to tell her version of what happened,” Lavell said. “And the evidence that he tried to retaliate.” Baldoni’s team, in turn, would present their defense, denying any wrongdoing and suggesting any negative press was of Lively’s own making.
Reputation and Hollywood’s Scrutiny
This high-profile case has drawn significant attention, involving private communications and even bringing other celebrities like Taylor Swift into the public discourse. Lavell commented on the broader impact on the actors’ careers, noting that litigation often harms celebrity brands.
“I think ultimately it’s hurt the reputation of both brought this case or got were involved with this case because litigation, court action only hurts celebrities,” Lavell explained. “A celebrity is as strong as his or her brand and once that brand is tarnished, it affects the livelihood. It affects the success and litigation will can do nothing but hurt a celebrity.” He stressed that while survival is possible, rebuilding a public image after such a publicized legal battle is a significant challenge.

With the trial date approaching and most claims dismissed, the pressure to settle is mounting. The focus will now be on the remaining claims of retaliation and breach of contract.
