While Border Patrol claimed they had placed him in a restaurant and followed all procedures, surveillance footage later revealed the restaurant was locked, and Alam was left outside. This incident has been cited as a stark illustration of the alleged cruelty and cover-up tactics employed by the administration.

In his ruling, Judge Quarishi described the government’s procedures as having “slid downward into manifest recklessness.” He noted that the U.S. Attorney’s Office in his district had conceded to violating 72 orders in immigration habeas cases alone, a number potentially underestimated. The judge expressed that the government’s continued actions, despite being called to task, could only be deemed intentional, stating, “The undersign will not stand idally by and allow this intentional misconduct to go on. It ends now.”

“While the procedures for the government’s immigration arrest and detention may have had the initial appearance of negligence, they have since slid downward into manifest recklessness. Immigrants are swept up into custody and shifted repeatedly around the country without warning or explanation. Efforts by the court in this district to protect detainees rights have been largely frustrated by the government.”

Judge Schultz in Minnesota observed that the Department of Justice’s credibility, built over generations, has been “squandered.” He noted that despite assurances of redoubled efforts to improve compliance, documentation revealed 113 additional orders violated in 77 cases, on top of previous violations. The judge emphasized the unprecedented nature of having to repeatedly threaten contempt to compel the U.S. government to comply with court orders, stating, “One way or another, ICE will comply. This court will continue to do whichever is required to protect the rule of law, including if necessary, moving to criminal contempt.”
