Carol Ann Tutera, whose husband lost his life savings to Gentile’s scam, shared her devastating experience. She explained how her investment advisor, David Gentile, presented a “great opportunity” with promises of high returns. Tutera, along with her sister and elderly mother, invested a total of half a million dollars. “I was shocked” when Gentile was released so soon after his conviction, Tutera stated.
Her sister, Julie Ullman, lost $100,000, a significant blow to her retirement plans. “I’ll be working a lot longer than I anticipated,” Ullman said, expressing the long-term financial impact of the fraud. The commutation meant Gentile no longer has to pay back $15 million in restitution, leaving victims like Tutera and Ullman with little hope of recovering their losses.

The Justice Department’s former pardon attorney, Liz Oyer, stated that traditional criteria for pardons include acceptance of responsibility, remorse, rehabilitation, and a strong record of good conduct. Prosecutors detailed how Gentile faked financial statements and misrepresented the source of investor payouts, which came from new investors rather than profits. They characterized his scheme as a hallmark Ponzi scheme, similar to the infamous Bernie Madoff case. “I felt like it was another Bernie Madoff deal,” Tutera remarked, highlighting the perceived similarity in the fraudulent operations.
